Terms and Conditions
1. Prices and terms of sale:
– Prices are quoted in Swiss francs (CHF) per bottle.
– Our prices are ex-cellar, including VAT.
– Payment is due within 10 days of invoice or in cash.
– For all new customers or first-time orders, full payment must be made before delivery or shipment.
– For customers residing outside Switzerland, all orders are payable in advance by bank transfer (including delivery costs).
– The wines remain the property of Cave des Amandiers until full payment of the invoice.
2. Prohibition of sale to minors
– By accepting the general terms and conditions, the customer certifies that they are at least
16 years of age, as required by law for the sale of wine, cider and beer.
3. Delivery and delivery costs
– Delivery costs are extra (link to delivery costs table), according to the carrier’s price list. Delivery is free for orders over CHF 900, including VAT.
- Once delivered, wines are generally neither returned nor exchanged, unless specifically agreed in writing with Cave des Amandiers SA. In this case, only boxes and bottles in perfect condition will be taken back and deducted from the final invoice; opened boxes and poorly stored wines will be automatically refused and invoiced to the purchaser.
– The customer acknowledges receipt of a wine delivery when they or one of their employees, even if not a director of the company, has signed the delivery note accompanying their wine order.
4. Collection of ordered wines
– Ordered wines must be collected within 60 days of the order date. After this period, the wines will be sent by carrier and shipping costs will be invoiced.
– For en primeur orders (reservations), the wine collection period is counted from the date of bottling.
5. Online sales
– Sales made via the Cave des Amandiers SA website, at
www.cavedesamandiers.ch, are automatically sent by carrier or post to the purchaser.
– Payment for the wines is made before they are dispatched.
6. Cork taint, defective bottles
– Cork is a natural product that allows wine to age, but can also sometimes, against our will, alter the wine. La Cave des Amandiers SA declines all responsibility in the event of a ‘corked’ taste. However, following discussion with the customer, the wines will be replaced provided that the corked or defective bottles are returned 3/4 full and with the original cork.
7. Wines sold en primeur
– If wines sold en primeur cannot be delivered, the customer shall only be entitled to a refund of the price paid, to the exclusion of any other damages.
8. Commitment of restaurateurs and resellers (distributors, wholesalers, wine merchants, etc.)
– By purchasing our wines, restaurant customers undertake to distribute and promote our wines in a manner that reflects their quality:
– Our bottles must not be displayed in shop windows. They must be stored in a room where the temperature, humidity and exposure to light are appropriate.
– Do not offer promotions or sales on our wines without prior written request and written approval from Cave des Amandiers SA.
9. Availability
– All our wines are produced from strictly limited harvests and, as vintages vary from year to year, production can vary significantly. For this reason, we reserve the right to adjust the quantities ordered according to our availability.
– If a vintage of a wine is no longer available, Cave des Amandiers SA reserves the right to send the new vintage of the same wine in place of the missing wine.
– Cave des Amandiers SA reserves the right to modify the range, prices and terms of sale, as well as delivery costs, at any time and without notice.
10. Validity of the General Terms and Conditions of Sale
– All orders for wine from Cave des Amandiers SA imply unconditional acceptance of these General Terms and Conditions of Sale.
– The parties expressly declare that any dispute arising from or in connection with this contract shall be resolved in accordance with Swiss law and that the place of jurisdiction shall be Martigny (Court of Martigny and Saint-Maurice).
